Yaz Lawsuit Recent Filing
07/03/2012 A Yaz Lawsuit and Jury Demand was filed in U.S. District Court in the Southern District of Illinois on behalf of the Plaintiffs Andrea Banes, Randall Banes, Erin Weiser and William Weiser. The Yaz Lawsuit alleges that Andrea Banes and Erin Weiser both suffered deep vein thrombosis, pulmonary embolism, gallbladder removal and/or other related injuries as a result of using the Yaz/Yasmin oral contraceptive products that the Defendants designed, manufactured, marketed, and distributed. Plaintiffs allege that there were defects in the manufacturing, design, and warnings provided for Yaz/Yasmin. Plaintiffs have demanded compensatory damages in excess of $75,000, medical expenses, and attorney’s fees for the injuries suffered by the Plaintiffs.
Yaz and Yasmin are called combination oral contraceptives because they contain both an estrogen and progestin component. The estrogen component is called ethiny estradiol and the progestin component is called drospirenone. Drospirenone is unlike any other progestin in any other contraceptive product on the market. The Complaint alleges that there is insufficient data available to support the safe use of drospirenone over other traditionally utilized progestins. The Complaint also alleges that due to the complications that can be caused by drospirenone there are significantly increased risks of harm with use of Yaz or Yasmin over other birth control pills. Plaintiffs assert that the Defendants not only ignored the increased risks of harm but chose to urge consumers to use Yaz/Yasmin over other safer alternatives.
Plaintiffs’ Complaint asserts eleven causes of action. Not only do the Plaintiffs allege that the design and manufacture of Yaz/Yasmin was defective, but they also stated that the warnings for the product were inadequate, that the Defendants committed fraud in continuing to market Yaz/Yasmin as “just as safe” as other birth control products, that the product breaches both express and implied warranties, that Defendants were unjustly enriched, that Randall Banes and William Weiser (spouses of Andrea Banes and Erin Weiser) lost the company and society of their spouses as a result of the injuries suffered, and that other laws were violated by Defendants in regards to their actions in designing, marketing and distributing Yaz/Yasmin.
